Terms of Service

These Terms govern your use of the MediaKeep for Instagram browser extension, its paid plan MediaKeep for Instagram Pro and the related web pages (together, the "Service"), provided by MediaKeep ("we", "us"). By installing or using the Service you agree to these Terms.

1. What the Service does

MediaKeep for Instagram is a browser extension that helps you save photos and videos that your own account can already view on Instagram (www.instagram.com) to your device. All processing happens locally in your browser, and the Service works with the Instagram session you are already signed in with.

MediaKeep for Instagram is an independent product. It is not affiliated with, endorsed by or sponsored by Instagram or Meta Platforms, Inc. ("Meta"). Instagram may change its website or service at any time, which can temporarily affect how the Service works.

2. Other MediaKeep products

MediaKeep for Telegram Web and its Pro plan are covered by separate terms. MediaKeep for Instagram Pro is a separate subscription from MediaKeep Pro for Telegram Web, and each license key works only in its own extension.

3. Your responsibilities

You may use the Service only to save media that you have the right to keep. In particular, you agree that you will not:

• download or redistribute content in violation of the copyright, image rights, privacy or other rights of the people who created or posted it;
• try to save content that Instagram restricts, such as posts of private accounts you do not follow, or try to work around such restrictions;
• use the Service in a way that breaks the law or Instagram's Terms of Use or Community Guidelines;
• cause excessive traffic to Instagram, for example by running bulk saves in several browsers or tabs at the same time, or by modifying the extension to remove its pacing or pause features;
• use the Service to collect media or post data in bulk for commercial purposes, such as building or selling datasets;
• resell, sublicense or share your license key outside the browser limit of your plan.

You are solely responsible for the media you download and for how you use it.

4. Instagram restrictions and responsibility

1. The Service requests post data from Instagram with your own Instagram account and signed-in session. Under its own rules, Instagram may slow down requests, temporarily limit features, ask you to verify your identity or suspend an account when it sees many requests in a short time or considers the use automated (together, "Restrictions").
2. If Instagram applies Restrictions to your account or connection because of how you use the Service – including causing excessive traffic, for example by loading or saving many posts in a short time – this is your responsibility, and we are not liable for any resulting loss, such as restrictions on your account, loss of access to posts or data, or loss of business. You use the Service with an understanding of this risk and at your own judgment.
3. To help protect your account, the Service paces its requests, takes breaks between pages and pauses when Instagram asks it to slow down. These features do not guarantee that Instagram will not apply Restrictions.
4. To prevent excessive traffic to Instagram, we may adjust or limit the request rate, the number of posts loaded at a time and the pause times of the Service.
5. If you cannot use part or all of the Service because of Restrictions or changes to Instagram, this is not a defect of the Service. Refund requests for this reason are handled within the scope of our Refund Policy.
6. Sections 4.2 to 4.5 do not apply to loss caused by our intent or gross negligence.

5. Plans, payment and licenses

The Service offers free features (saving single posts and previewing an account's posts) and a paid Pro plan (saving several selected posts at once). Current features and prices are shown on our pricing page and may change; changes to paid plans apply from your next billing period.

Our order process is conducted by our online reseller and Merchant of Record, Gumroad. Gumroad processes payments, calculates sales tax and issues receipts, and its own terms apply to your purchase. After purchase you receive a personal, non-transferable license key that unlocks Pro features on up to 3 browsers.

Subscriptions renew automatically until cancelled. You can cancel at any time from the link in your receipt email; Pro remains active until the end of the paid period. Refunds are described in our Refund Policy.

6. License to use the software

We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal or internal business use. You may not copy, modify, reverse engineer or redistribute the extension except as allowed by law, or remove or bypass its license checks or its request pacing.

7. Ownership of content

Photos, videos and other content posted on Instagram belong to the people who created or posted them. The Service does not grant you any right to use that content. Instagram is a trademark of Meta Platforms, Inc.

8. Availability and changes

We aim to keep the Service working but do not guarantee that it will be uninterrupted or error-free, especially after changes to Instagram. We may update, change or discontinue features. If we discontinue the paid Service, we will refund the unused part of any prepaid subscription.

9. Disclaimer

The Service is provided "as is" and "as available", without warranties of any kind, to the extent permitted by law.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential damages, or for loss of data, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. If a dispute with a third party arises because you breached these Terms or the law, you are responsible for resolving it at your own cost. Nothing in these Terms limits liability for our intent or gross negligence, or liability that cannot be limited under applicable consumer protection law.

11. Termination

We may suspend or revoke a license that is used in breach of these Terms or in a way that causes excessive traffic to Instagram. You may stop using the Service at any time by uninstalling the extension.

12. Changes to these Terms

We may update these Terms. We will post the new version on this page with a new date, and for material changes we will notify Pro customers by email.

13. Governing law and contact

These Terms are governed by the laws of the Republic of Korea, without prejudice to mandatory consumer protection rules of your country of residence. Questions: contact@randomlab.kr.
